Welcome to Successful Mathematics. These Terms & Conditions of Service (hereinafter referred to as the "Agreement" or "Terms") constitute a legally binding, enforceable contract executed by and between Successful Mathematics LLC, a Delaware limited liability corporation (together with its parent, subsidiary entities, affiliates, successors, and assigns, "Successful Mathematics," the "Company," "we," "us," or "our"), and any individual or corporate entity (hereinafter "User," "you," or "your") accessing or utilizing the digital platform, subdomains, curriculum repositories, interactive utilities, and educational suites hosted at successfulmathematics.com and associated network endpoints (collectively, the "Services").
By executing the account registration protocol, accessing any component of the Services, or continuing to browse Company interfaces, you explicitly acknowledge and warrant that you have read, understood, and consented to be bound in full by this Agreement. If you are acting as an agent for an institutional or educational entity, you warrant that you possess the requisite administrative authority to bind said institution. If you do not consent to all conditions contained herein, you are strictly prohibited from utilizing the Services and must immediately cease all access.
1. Account Provisioning, Credentials Custody, and Security Covenants
To access proprietary educational materials and progress tracking metrics, Users must create an authorized credential profile. You agree to adhere to the following covenants:
- Accuracy of Information: You represent and warrant that all data provided during account provisioning is accurate, current, and complete, and you commit to maintaining the accuracy of such records immediately following any administrative changes.
- Credentials Confidentiality: Account credentials are strictly personal and non-transferable. The sharing, distribution, or licensing of user identifiers, passwords, or access tokens is explicitly prohibited. Any unauthorized utilization of credentials resulting from failure to secure access details remains your sole responsibility.
- Multi-Factor Authentication (MFA) Mandate: In alignment with student information safety protocols, all Instructor, Educator, and Administrator accounts must activate and utilize Multi-Factor Authentication. Failure to maintain active MFA configuration constitutes a breach of safety protocols and may result in administrative account suspension.
2. Permissible Conduct, Anti-Cheating Telemetry, & Academic Integrity Covenants
Our Services serve as a secure educational assessment and diagnostic platform. Users agree to maintain absolute compliance with academic integrity standards:
- Cheating Prevention Telemetry: To guarantee grading fairness, the Services integrate advanced client-side telemetry systems. These systems monitor browser interactions (including tab-switching, focus loss, window resizing, copying actions, right-clicks, print attempts, and devtools execution). You consent to this tracking while using assessment modes.
- Prohibited Actions: Users are prohibited from using external software scripts, artificial intelligence solvers, browser extensions, or automated macros to generate mathematical solutions. Copying content, sharing answers, or circumventing anti-cheating mechanisms is a material violation of this agreement.
- Sanctions: Verified violations of academic integrity policies will result in immediate suspension, forfeiture of MathCoins and system achievements, and reporting to your affiliated educational institution or school district administrators.
3. Proprietary Intellectual Property Rights, Copyright Covenants, & Revocable Licensing
All aspects of the Services—including mathematical questions, algorithmic pipelines, explanation structures, digital assets, video files, software code (compiled and source), graphics, and interactive design layouts—remain the exclusive property of Successful Mathematics LLC.
Subject to compliance with these Terms and payment of applicable fees, the Company grants you a limited, non-exclusive, non-transferable, revocable license to access the Services strictly for personal, non-commercial educational purposes. You may not scrape, compile, reverse-engineer, distribute, sell, or copy any digital assets without explicit prior written authorization from the Company.
4. Virtual Currency Mechanics (MathCoins): Status, Entitlements, and Non-Monetary Nature
The Services utilize a promotional rewards asset denominated as "MathCoins":
- Exclusion of Value: MathCoins are virtual tokens representing a limited, revocable, non-transferable license to access digital store items (e.g., UI skins, virtual accessories, tool upgrades). MathCoins possess no real-world monetary value, do not accrue interest, and cannot be redeemed for legal tender under any circumstances.
- Regulatory Rights: The Company reserves the absolute right to manage, modify, restrict, revalue, or delete MathCoins, store inventories, or acquisition ratios at its sole discretion, without liability or prior notification to any User. MathCoins are strictly non-refundable and expire upon account deletion.
5. Financial Consideration, Recurring Subscription Mechanics, & Non-Refundability Covenants
Premium options and advanced features (such as Pro or Ultra subscription tiers) require financial consideration:
- Automatic Renewal: Subscription packages auto-renew at the end of each billing cycle (monthly or annually) unless canceled prior to the renewal date.
- Payment Integration (Stripe): All financial transactions are managed by Stripe. By entering financial details, you warrant that you are authorized to use the payment method and agree to adhere to Stripe's processing conditions.
- No-Refund Standard: All subscription payments, licensing fees, and virtual currency acquisitions are non-refundable. Cancellations halt future recurring charges but do not entitle the User to pro-rated refunds for the active billing cycle.
6. User-Generated Content: License Grants, Moderation, and Proprietary Indemnity
If you upload, post, or submit content (e.g., custom flashcards, study schedules, forum messages), you grant the Company a royalty-free, perpetual, irrevocable, worldwide, non-exclusive license to use, display, reproduce, and distribute such assets for operational improvements. You represent that you possess all intellectual property rights to submitted content and agree to indemnify the Company against third-party copyright claims.
7. Disclaimer of Warranties, Indemnification, and Absolute Limitation of Liability
Disclaimer: The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. We do not warrant that the Services will remain secure, uninterrupted, error-free, or compatible with all client hardware configurations.
Limitation of Liability: Under no legal theory (contract, tort, or strict liability) shall Successful Mathematics LLC be liable for indirect, incidental, special, punitive, or consequential damages. Our total liability for any claims arising out of this agreement shall not exceed the total fees paid by you to the Company in the twelve (12) months preceding the incident.
8. Dispute Resolution, Governing Law, Venue Selection, and Binding Class-Action Waiver Arbitration
This Agreement is governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute, controversy, or legal claim arising out of this Agreement or use of the Services shall be settled through confidential, binding arbitration administered in the State of Delaware. You agree to waive any constitutional or statutory right to participate in a class-action lawsuit or class-wide arbitration proceedings.
9. Term, Suspension, & Unilateral Right of Discontinuance
This Agreement remains in effect until your account is terminated. The Company reserves the unilateral right to suspend or delete accounts, forfeit associated digital assets, and block network access without notice or liability, should a User violate academic integrity policies, engage in unauthorized code modifications, or fail to complete payment obligations.
