School and District Terms
Last revised: October 28, 2026
These terms apply when a school, school district, college or other educational institution (the "School") buys or uses Successful Mathematics for its pupils, whether through a quote, invoice, purchase order, license, seats or a class roster. They form part of the agreement between the School and Successful Mathematics LLC ("we") and take priority over our general Terms & Conditions where the two differ. A data privacy agreement we have signed with the School, or contract terms the School and we have both signed, take priority over both.
1. The School controls its pupils' data
- "Pupil data" means personal information about the School's pupils that we receive or create because the School uses the Services, including their answers, scores, progress, messages and uploads. It is part of the pupils' education records and belongs to the School.
- We act as a "school official" under the Family Educational Rights and Privacy Act (FERPA), under the School's direct control for how pupil data is used and kept. We use pupil data only to provide the Services to the School and its pupils, and to keep them secure and working.
- We do not sell pupil data, use it for advertising or to target advertising, or build profiles of pupils for any purpose other than the School's educational purposes (for example, choosing the next practice question).
- We disclose pupil data only to the service providers on our subprocessor list, which handle it only to run the Services, to the people the School links to a pupil (their teachers, parents and the School's administrators), as the School instructs, or where the law requires. If the law requires us to disclose it, we will tell the School first unless the law forbids that.
- We may use information that has been de-identified, so that it cannot reasonably be linked to a pupil or the School, to improve the Services.
- Work pupils create belongs to the pupils and the School. The content license in section 6 of the general Terms does not apply to pupil data: we use it only as these terms allow.
2. Access and correction
The School's teachers and administrators can see their pupils' work in the Services. Parents and eligible pupils should make requests to see or correct education records to the School. If the School needs our help to answer one, we will give it within 30 days of the School's request. If a parent or pupil asks us directly, we will refer them to the School.
3. Security
- Pupil data travels encrypted (HTTPS/TLS) and is encrypted at rest by our database provider. Our database, application servers and website run in the United States.
- Database access rules limit each account to the records it may see. Our staff see pupil data only when they need to, to support the School or keep the Services working.
4. If there is a breach
If we confirm that pupil data has been accessed or disclosed without authorization, we will tell the School without unreasonable delay and within 72 hours, or sooner if the School's state law requires it. We will say what happened, which data and pupils were affected, what we have done about it, and who to contact. We will cooperate with the School in notifying families and authorities.
5. Deleting pupil data
- When the School's license ends, or at any time on the School's written request, we will delete the pupil data of the accounts the School manages within 60 days, or return it to the School first in a common format if it asks. Copies in our backups are overwritten within 7 days after that.
- We keep only what the law requires us to keep, such as purchase records, with pupils' personal details removed.
- A pupil's own personal account, created by the pupil or their family and not through the School, is not pupil data under these terms; it continues under our Privacy Policy.
- On request we will confirm in writing that the deletion has been done.
6. Consent for children under 13
Where the School uses the Services for its pupils' education, the School may give consent under the Children's Online Privacy Protection Act (COPPA) on parents' behalf, for educational use only, as the Federal Trade Commission allows. The School is responsible for any notice to parents its own policies require. We use information collected this way only for the School's educational purposes.
7. Data privacy agreements
We sign the Student Data Privacy Consortium's National Data Privacy Agreement and its state versions, and documents a state requires, such as New York's Parents' Bill of Rights for Data Privacy and Security with its supplemental information. See Data Privacy Agreements for how to request one.
8. Public schools and other public bodies
If the School is a public body:
- The arbitration, class-action waiver and opt-out provisions in section 8 of the general Terms do not apply. Disputes go to the courts that have jurisdiction under the law that governs the School's contract.
- Where the School's law requires its own state's law to govern its contracts, that law governs this agreement.
- Any promise by the School to indemnify us, or to accept a limit on our liability, applies only as far as the School's law allows.
9. Orders and payment
Seats, prices, the license period and payment terms are those in the School's quote, invoice or order. Section 5 of the general Terms covers anything an order does not.
10. Changes
We may update these terms, and will change the date at the top when we do. A change that reduces the protection of pupil data does not apply to a School during a license period it has already paid for unless the School agrees in writing. We will give Schools at least 30 days' notice of a new service provider that will handle pupil data, on our subprocessor list.
